This document outlines the Terms of Service (“Terms”) that govern your relationship with New Skin Laser Studio Inc. (“Studio,” “we,” “us,” “our”) and your use of our website, www.newskinlaserstudio.ca (the “Website”), and all related aesthetic and medical-aesthetic services (“Services”).

 

Introduction and Acceptance of Terms

 

1.1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“Client,” “you,” or “your”), and New Skin Laser Studio Inc., concerning your access to and use of the Website and our Services. By accessing the Website, booking an appointment, purchasing a product, or using any of our Services, you acknowledge that you have read, understood, and unconditionally agree to be bound by all of these Terms. The act of using the Website or engaging our Services signifies your acceptance of this agreement, creating a contract between you and the Studio. Canadian courts have consistently recognized that such online terms, when presented clearly, form a valid and enforceable contract.

 

This agreement is intended to apply broadly and it governs any and all access and use of the Website, the information or content contained on the Website, and all aspects of the Services. Your compliance with these Terms is a condition of your use of the Website and receipt of Services.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND OUR SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY. This explicit directive is included to ensure there is no ambiguity regarding your acceptance of these binding conditions.

To ensure clarity and prevent misinterpretation, the words of which the initial letter is capitalized have meanings defined under the following conditions. These definitions shall have the same meaning regardless of whether they appear in singular or plural form.

  • “Studio,” “We,” “Us,” “Our”: Refers to New Skin Laser Studio Inc., a corporation registered in the Province of Alberta, Canada, including its directors, officers, employees, agents, and all licensed medical and aesthetic practitioners performing services on its behalf.
  • “Client,” “You,” “Your”: Refers to the individual accessing or using the Website, booking an appointment, purchasing products, or receiving Services. This term also includes the parent or legal guardian of a minor who is receiving services, where that parent or guardian has provided consent and agreed to these Terms on the minor’s behalf.
  • “Services”: Encompasses the full range of treatments, procedures, consultations, and products offered or provided by the Studio. This includes, without limitation, laser hair removal, laser skin rejuvenation, photofacials (IPL), cosmetic injectables (such as neuromodulators and dermal fillers), medical-grade facials, chemical peels, microneedling (collagen induction therapy), and the sale of associated skincare products.
  • “Website”: Refers to the internet domain www.newskinlaserstudio.ca and all of its associated pages, content, features, and functionality.
  • “Content”: Includes all written and other materials displayed or made available through the Website, including, but not limited to, articles, text, photographs, images, illustrations, graphics, logos, audio clips, video clips, computer software, and code.

 

1.3. Eligibility

By using our Website and Services, you represent and warrant that you are at least the age of majority in your province of residence, which is 18 years old in Alberta. If you are under the age of 18 (a “Minor”), you may only use our Services with the express consent and supervision of a parent or legal guardian. In such cases, the parent or legal guardian is deemed to have accepted these Terms on behalf of the Minor, is fully responsible for the Minor’s compliance with these Terms, and assumes all liabilities arising from the Minor’s use of our Services.

 

Certain Services may have specific age restrictions. For the safety and well-being of all clients, any individual under the age of 16 must be accompanied by a parent or legal guardian at all times while at the Studio, and the parent or guardian must sign all required consultation and consent forms. The Studio reserves the right to request government-issued identification to verify age.

 

1.4. Changes to Terms

The Studio reserves the right, in our sole discretion, to make changes, modifications, additions, or deletions to these Terms at any time and for any reason. We will alert you about any changes by updating the “Effective Date” at the top of this document. By continuing to use the Website or our Services after such revisions are posted, you waive any right to receive specific, individual notice of each such change and are deemed to have been made aware of and to have accepted the changes in any revised Terms.

 

It is your responsibility to periodically review these Terms to stay informed of updates. The most current version of the Terms will supersede all previous versions. This mechanism ensures that our operating policies can evolve with industry standards and legal requirements while maintaining a clear and continuous agreement with our clients.

Our offerings are performed by trained and certified professionals in accordance with industry standards and provincial regulations. Services include, but are not limited to:

  • Laser Treatments: Laser Hair Removal, IPL Photofacials (for pigmentation, rosacea, and vascular lesions), and Laser Skin Resurfacing (for texture, wrinkles, and collagen stimulation).
  • Cosmetic Injectables: Neuromodulator injections (e.g., Botox®, Dysport®) to relax lines and wrinkles, and Dermal Fillers (e.g., Juvéderm®, Restylane®) to restore volume and contour the face. These are controlled acts and are administered in compliance with all applicable regulations from the College of Physicians and Surgeons of Alberta (CPSA) and other relevant professional bodies.
  • Skin Rejuvenation: Medical-Grade Facials, Chemical Peels, and Microneedling (Collagen Induction Therapy) to improve skin tone, texture, and overall health.
  • Body Contouring: Non-invasive treatments designed to reduce unwanted fat and improve body shape.

This process ensures that we can provide services safely and effectively, in compliance with the standards of care and provincial health regulations.

 

New Skin Laser Studio reserves the right, in its sole and absolute discretion, to refuse to provide or to discontinue Services to any individual at any time. This right may be exercised if a treatment is deemed medically inappropriate, if a client’s health status or undisclosed condition poses a safety risk, if a client fails to adhere to pre- or post-care instructions, or if a client exhibits behavior that violates our Zero Tolerance Policy. This policy is a fundamental component of our commitment to patient safety and professional ethics.

 

3.4. Results Not Guaranteed & Individual Variation

The practice of aesthetic medicine is not an exact science, and individual results from any treatment can and will vary. Factors such as age, skin type, genetic predisposition, lifestyle, medical history, and individual healing response can significantly impact the outcome of a procedure.

 

Therefore, New Skin Laser Studio makes no representations, warranties, or guarantees, either express or implied, regarding the specific outcomes, longevity of results, or the degree of improvement you may experience from any Service. The information and “before and after” photographs presented on the Website or in our promotional materials are for illustrative purposes only. They are examples of typical results but are not intended to represent the results that every client can or will achieve. During your consultation, our practitioners will provide a realistic assessment of the potential results based on your individual characteristics, but this does not constitute a guarantee of a specific outcome. Your decision to proceed with any treatment is based on your understanding and acceptance of this variability.

 

Client Responsibilities and Conduct

 

4.1. Provision of Accurate and Complete Information

The safety and efficacy of our Services are critically dependent on the accuracy and completeness of the information you provide. As a client, you accept sole responsibility for providing truthful, accurate, and complete personal and medical information on all intake forms and during all consultations. This obligation includes, but is not limited to, a full disclosure of :

  • All current and past medical conditions, including autoimmune disorders, skin conditions (e.g., eczema, psoriasis), and history of keloid scarring.
  • All current medications, both prescription and over-the-counter (e.g., antibiotics, Accutane).
  • All supplements, vitamins, and herbal remedies you are taking (e.g., St. John’s Wort, fish oil).
  • All known allergies.
  • All previous cosmetic procedures, including surgeries, laser treatments, and injectables.
  • Pregnancy or breastfeeding status.

 

New Skin Laser Studio and its practitioners will rely on the information you provide to make treatment decisions. We shall not be held liable for any adverse reactions, injuries, complications, or unsatisfactory results that arise from your failure to disclose relevant and accurate information. You assume all responsibility for updating us on any changes to your physical or mental condition.

 

4.2. Adherence to Pre- and Post-Treatment Instructions

For every treatment we offer, you will be provided with specific pre- and post-care instructions. These protocols are designed to prepare your skin for the procedure, maximize the effectiveness of the treatment, minimize the risk of complications, and support a healthy healing process. You agree to read, understand, and strictly adhere to all such instructions provided by our practitioners.

Failure to follow these instructions may compromise your treatment results and could lead to adverse effects such as hyperpigmentation, infection, or scarring. The Studio will not be held liable for any complications or suboptimal outcomes resulting from your non-compliance with these essential care guidelines. Detailed instructions will be provided for specific services, including but not limited to Laser Skin Rejuvenation , Microneedling , and Chemical Peels.

 

4.3. Client Eligibility and Contraindications

It is your responsibility to review and understand that certain medical conditions, medications, or recent activities may make you temporarily or permanently ineligible for specific treatments. These are known as contraindications. A non-exhaustive list of common contraindications is provided below for your reference. You must discuss any applicable conditions with your practitioner during your consultation. This proactive disclosure is a cornerstone of our safety protocol and is required by provincial health standards.

4.4. Studio Etiquette and Zero Tolerance Policy

We are committed to providing a professional, welcoming, and safe environment for all our clients and staff. To achieve this, we expect all clients to treat our team and fellow clients with respect, kindness, and courtesy.

 

New Skin Laser Studio maintains a strict Zero Tolerance Policy regarding unruly or disrespectful behavior. Unacceptable conduct includes, but is not limited to: verbal abuse, swearing, yelling, threats, physical aggression, harassment, or discrimination of any kind. Any client exhibiting such behavior will have their service terminated immediately, will be asked to leave the premises, and may be refused future service at our sole discretion. This policy is strictly enforced to protect the safety and well-being of our staff and clients.

 

4.5. Children and Pets on Premises

To ensure the safety of your children, maintain a serene and professional medical environment, and comply with health and safety regulations, we kindly request that you make childcare arrangements prior to your appointment. For safety and liability reasons, children are not permitted in treatment rooms. Furthermore, children cannot be left unattended in the reception area at any time.

 

With the exception of certified service animals as defined by Alberta law, pets are not permitted in the Studio. Clients who arrive for their appointment accompanied by children or pets may be required to reschedule their service and may be subject to the applicable cancellation fee. We appreciate your understanding and cooperation in helping us maintain a safe and relaxing atmosphere for all our guests.

 

Appointments, Payments, and Cancellations

 

5.1. Booking Appointments and Deposits

Appointments can be scheduled through our online booking system, by telephone, or in person at the Studio. To secure your appointment, we require a valid credit card to be kept on file. This card will not be charged at the time of booking unless a deposit is required; it serves as security for our cancellation policy.

 

For all new clients, group bookings, spa packages, or appointments exceeding two hours in length, a deposit may be required to reserve the appointment time. This deposit is non-refundable but will be applied toward the final cost of your service on the day of your appointment. This policy ensures commitment to the reserved time and is a standard practice within the Edmonton aesthetic services market.

 

5.2. Pricing and Payment

All prices for Services and products are listed in Canadian Dollars (CAD) and do not include Goods and Services Tax (GST). Prices are subject to change without prior notice; however, the price for your scheduled service will be confirmed at the time of booking.

 

Full payment for all Services rendered and products purchased is required at the time of your appointment. We accept payment by Cash, Debit, Visa, and MasterCard. Please note that personal cheques are not an accepted form of payment.

 

5.3. Cancellation, Rescheduling, and No-Show Policy

Your appointment time is reserved exclusively for you. When you book an appointment, we dedicate our time and resources to your care. Last-minute cancellations and no-shows significantly impact our ability to serve other clients on our waiting list and affect our practitioners’ schedules. Therefore, we strictly enforce the following policy, which is aligned with industry standards in Edmonton :

  • Notice Period: We require a minimum of 48 hours’ notice for any cancellation or rescheduling of a scheduled appointment. This notice must be provided by telephone or email.
  • Late Cancellation Fee: Cancellations or rescheduling requests made with less than 48 hours’ notice will be subject to a cancellation fee. The fee structure is as follows:
    • $100 for all Medical Aesthetic appointments (e.g., laser treatments, facials, chemical peels, microneedling).
    • $150 for all Cosmetic Injectable appointments (e.g., neuromodulators, dermal fillers).
  • No-Show Fee: If you fail to attend your scheduled appointment without providing any prior notice (“No-Show”), you will be charged the full applicable late cancellation fee.
  • Enforcement: The cancellation or no-show fee will be automatically charged to the credit card on file. If you have a prepaid package, a late cancellation or no-show will result in the forfeiture of one treatment session from your package in lieu of the fee. You will not be able to book any future appointments until all outstanding fees have been paid in full. We understand that verifiable emergencies may occur and may waive the fee at our sole discretion.

 

5.4. Late Arrivals

We recommend arriving 10-15 minutes prior to your scheduled appointment time to allow for a stress-free check-in, completion of any necessary forms, and a moment to relax. Punctuality is essential to ensure you receive your full treatment and to respect the time of clients scheduled after you.

 

Arriving late will result in a shortened treatment time, as we must conclude the service at the scheduled end time to accommodate the next client. The full price of the originally scheduled service will still apply. If you arrive more than 15 minutes late for your appointment, we reserve the right to cancel the appointment entirely, and it will be treated as a “No-Show,” subject to the full cancellation fee.

 

5.5. Refund Policy

  • Services, Packages, and Gift Certificates: All sales are final. We do not offer refunds on services that have been rendered, prepaid treatment packages, or purchased gift certificates. Aesthetic results are variable and cannot be guaranteed; therefore, dissatisfaction with a subjective outcome is not grounds for a refund. We do not provide refunds for change of mind.
  • Products: We do not offer refunds on retail products purchased. However, a product may be exchanged for the same item within 14 days of purchase if it is found to be defective. In the rare event of a documented allergic reaction to a product, an exchange or store credit may be offered at our discretion, provided proof of the reaction is supplied. Opened or used products are not eligible for return or exchange.
  • Service Quality Concerns: Your satisfaction is important to us. While we do not offer refunds, if you have a concern regarding the quality of a service you received, please contact the Studio within 48 hours of your appointment. We are committed to addressing your concerns and, at our discretion, may offer a complimentary follow-up or touch-up service to remedy the issue.

 

5.6. Gift Cards and Promotions

  • Gift Cards: Gift cards are available for purchase and make an excellent gift. They are non-refundable and cannot be redeemed for cash. The physical or digital gift card must be presented at the time of payment. The Studio is not responsible for lost or stolen gift cards.
  • Promotions: From time to time, the Studio may offer promotional pricing or packages. All promotional offers are valid only for the specified time period and are subject to the terms and conditions of that specific offer. Promotions cannot be combined with other discounts unless explicitly stated. Treatments purchased as part of a promotion must be scheduled and received within the promotional period or according to the terms of the offer.

 

Liability, Disclaimers, and Legal Provisions

 

6.1. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Website, its Content, and all Services and products provided by New Skin Laser Studio are provided on an “AS IS” and “AS AVAILABLE” basis. New Skin Laser Studio expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

 

We do not warrant or make any representations that: (i) the Website or Services will meet your requirements; (ii) the information on the Website will be correct, accurate, current, or timely; (iii) the use of the Website will be uninterrupted, secure, or error-free; or (iv) any defects will be corrected. You acknowledge that any information or materials found on this website may contain inaccuracies or errors, and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information, materials, or Services is entirely at your own risk.

 

6.2. Limitation of Liability

This clause forms a fundamental part of our agreement and serves to manage the risks associated with providing aesthetic services. To the maximum extent permitted by applicable law, in no event shall New Skin Laser Studio, its directors, officers, employees, agents, or licensors be liable for any special, direct, indirect, punitive, incidental, or consequential damages whatsoever.

 

This limitation of liability includes, but is not limited to, damages for personal injury, pain and suffering, emotional distress, loss of profits, loss of data or other information, business interruption, or any other commercial damages or losses, arising out of or in any way connected with: (i) your use of, or inability to use, the Website or Services; (ii) any information or content obtained from the Website; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein; or (iv) any statement or conduct of any third party on the Service. This limitation applies regardless of whether the claim is based on warranty, contract, tort (including negligence), or any other legal theory, and even if the Studio has been advised of the possibility of such damages.

 

Notwithstanding any damages that you might incur, the entire liability of the Studio and any of its suppliers under any provision of these Terms, and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you to the Studio for the specific Service giving rise to the claim.

 

6.3. Indemnification

You agree to defend, indemnify, and hold harmless New Skin Laser Studio, its affiliates, and their respective officers, directors, employees, agents, and licensors from and against any and all claims, demands, losses, damages, liabilities, penalties, punitive damages, expenses, and costs, including reasonable legal fees and disbursements, arising out of or in any way connected with :

  • (i) Your use of and access to the Website and our Services;
  • (ii) Your breach of any term, condition, representation, or warranty of this Agreement;
  • (iii) Your violation of any applicable law or the rights of a third party, including without limitation any copyright, property, or privacy right; or
  • (iv) Any claim that your actions caused damage to a third party.

 

This indemnification obligation means you agree to cover the financial costs incurred by the Studio if it is sued or faces legal action as a result of your actions or breach of this agreement. This is a standard but essential risk-shifting provision in commercial contracts. This indemnification clause will survive the termination of this Agreement and your use of the Services.

 

6.4. Privacy and Personal Information

By agreeing to these Terms, you acknowledge that you have read, understood, and consented to the data handling practices described in our Privacy Policy. 6.5. Dispute Resolution

It is our goal to resolve any disagreements amicably and efficiently. To this end, you and New Skin Laser Studio agree to the following multi-tiered dispute resolution process for any claim, dispute, or controversy arising out of or relating to these Terms or the Services :

  • a. Informal Negotiation: The parties agree to first attempt to resolve any dispute by good-faith informal negotiation. The party initiating the dispute must send a written Notice of Dispute to the other party, and both parties will use their best efforts to settle the matter for a period of at least thirty (30) days from the date the notice is sent.
  • b. Mediation: If the dispute cannot be resolved through informal negotiation within the 30-day period, the parties agree to endeavor to settle the dispute by mediation administered by a neutral third-party mediator in Edmonton, Alberta, before resorting to arbitration or litigation. The costs of mediation will be shared equally between the parties.
  • c. Governing Law and Jurisdiction: Should negotiation and mediation fail, any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of the Province of Alberta, located in the City of Edmonton, as stipulated in Section 6.6.

 

6.6. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

 

You irrevocably and unconditionally agree and attorn to the exclusive jurisdiction of the courts of the Province of Alberta, located in the City of Edmonton, to settle any dispute, claim, or controversy that arises out of or in connection with this Agreement. By agreeing to this “forum selection” clause, you waive any objection to the venue of such courts and any claim that such forum is inconvenient. This ensures that any legal proceedings will be conducted in a predictable legal environment, local to our operations.

 

6.7. General Provisions

  • Severability: If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
  • Entire Agreement: These Terms, together with our Privacy Policy and any client consent forms you may sign for specific procedures, constitute the entire agreement between you and New Skin Laser Studio with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
  • Force Majeure: New Skin Laser Studio will not be held liable or responsible for any delay or failure in performance of its obligations under these Terms which arises from or is due to any cause or circumstance beyond its reasonable control. Such causes include, but are not limited to, acts of God, war, strikes or labor disputes, public health emergencies, government orders or restrictions, power failures, or extreme weather events.
  • Waiver: The failure of the Studio to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of New Skin Laser Studio.

Very good service! Shelby took care of me a couple times, got hair removal laser done on my shoulders. The area that I got the treatment done on, reduced the growth of my hair. Getting treatment done on my face soon for acne scars. Had been to a few different places to get treatments on my face in south Edmonton, and they are definitely not comparable to here.
